DAVID SACHS is a partner at Horwood Marcus & Berk and a member of our Real Estate Group.

David is a sophisticated real estate attorney, focused on all aspects of real estate transactions, including purchases, sales, leasing and financing for industrial, residential, commercial and mixed use properties and developments.

He has acted as general counsel to developers and investors in every facet of their business from acquisition, development, construction, financing and leasing - making him an invaluable resource for any person or entity with real property as a significant portion of their assets or growth plans. 

One of David's key differentiators is his wealth of experience in real estate as well as corporate matters and litigation.  His broad background enables him to provide practical advice which considers the various aspects of any transaction.

His experience includes:

  • Representing developers, other commercial businesses and investors with the purchase, lease and sale of all types of real estate assets
  • Establishing and operating residential and mixed use developments
  • Handling landlord/tenant matters, day-to-day property management and construction issues, including negotiating and drafting contracts with contractors and architects
  • Acquiring, exchanging, selling, financing and leasing vacant, improved and environmentally challenged properties
  • Advising both owners and lenders on their financially-distressed properties, including workouts, consent foreclosures and deeds in lieu of foreclosure
  • Counseling on entity selection, organization and day-to-day business operations, including preparing and reviewing contracts and leases and assisting with vendor, customer and lender issues
  • Representing restaurant owners and operators in various aspects of restaurant operations, including purchasing and selling existing restaurants, establishing new locations, and licensing and endorsement agreements permitting the use of their names, likenesses and products
  • When leading transactions, David focuses on closing the deal as efficiently as possible, while ensuring his clients' unique business needs and goals are always kept at the forefront

David also approaches real estate litigation with an efficient, objective-focused methodology.  He has handled commercial, industrial and individual litigation involving real estate contracts, property and construction disputes, landlord-tenant cases, foreclosure and mechanic's lien matters, creditor's rights in post-judgment, as well as bankruptcy cases and disputes between title insurance companies and policyholders.
