We regularly represent financial institutions and borrowers in secured and unsecured credit facilities which involve real estate, whether the credit facility is being secured by real estate or is for the acquisition and development of real estate.  This includes the negotiation and documentation of term and revolving credit loans, mortgage loans, subordinated loans and other multi-faceted financing arrangements. 

The HMB Real Estate Group represents borrowers, senior lenders, mezzanine lenders, equity sponsors, management groups, sellers and participants in every imaginable form of debt and equity financing.  Our attorneys are highly experienced in the nuances of negotiating and documenting mortgage loan documentation, equity and profit participation agreements, warrant and stock purchase agreements, letters of credit, intercreditor agreements, guaranties and subordination agreements.  In addition, we have extensive experience with CMBS financing, including loan assumptions and defeasance, as well as forbearance agreements and other "work-out" type modification scenarios.
