  • Whether enacted platform laws violate the federal law

David Machemer presents "Sales Tax Considerations with the Sale/Purchase of a Leased-Asset Portfolio"

In this session, attendees will:

  • Identify the basics of equipment and motor vehicle leasing and issues to be aware of when selling some or all of a lease asset portfolio, transferring leased assets via intercompany transfer or securitizing lease portfolios
  • Recognize the major differences between asset sales and entity sales and the tax consequences of each
  • Evaluate the implications of Wayfair and nexus on sales of leased assets
  • Determine how to create a document trail for potential examination by taxing authorities
  • Recognize the implications of sourcing leased assets and state specific issues to consider
