Case No. 07 L 050091 (Consolidated with Case No. 10 L 050181)

Brandenburg Industrial Service Co. v. Brian Hamer, Illinois Department of Revenue, and Dan Rutherford

This case involves the Illinois Department of Revenue's assessment of use tax to purchases made by Brandenburg Industrial Service Company between July 2000 and June 2007. The Department claims that Brandenburg owes $664,854.02 in unpaid use tax, interest, and penalties. Brandenburg has paid that amount under protest and now denies that it owes the assessed use tax, interest, and penalties because of numberous errors made by the Department in preparing its Notices of Tax Liability, including, but not limited to, determining that Brandenburg was not entitled to certain use tax exemptions. Brandenburg seeks a judgment awarding it a refund of all amounts it paid under protest plus interest.
