Over the past few years, there has been a multitude of litigation concerning the proper application of state and local hotel taxes and related sales and excise taxes on online travel companies (OTCs) - specifically, whether the taxes should be collected based on the wholesale amount the OTC pays the hotel for the room, or the amount the customer pays, including fees, to the OTC. This report includes a discussion about this controversy and brings up a number of other state and local tax issues.
