8:45 - 9:45am - The "Worst" Recent Judicial Opinions  - An overview of egregious case law developments from regions across the country.  Fred O. Marcus and Samantha K. Breslow, Camp Counselors

9:45 - 10:45am - Sales and Use Tax Treatment of Leasing Transactions:  Rules, Pitfalls and the Opportunities - While many states include the term "lease" in their definition of retail sale, practitioners and taxpayers should not assume that the taxation of each are identical.  In this session, we will identify some pitfalls to avoid and highlight some opportunities for both lessors and lessees.  This session will focus on the nuances in the state taxation of leases and how to manage the issues that arise in this area of the law.       David A. 11:00am - 12:00pm - Tax Base Conformity - Really! - While the starting point for state corporate income taxes may be federal taxable income the conformity generally stops there.  This session will discuss the complex issues that arise as states decouple from the Internal Revenue Code.  These issues are likely to be compounded by federal tax reform.  The presentation will examine traps for the unwary including the vagrancies of the federal consolidated return rules and the application of those rules to state corporate income taxes.  Marilyn A. 1:00 - 2:00pm - Debate Over Nexus for Sales/Use Taxes - Are We Headed Towards a New Frontier? -  Some states, such as Alabama, are challenging Quill's physical presence test by regulation while others, such as South Dakota, are challenging it with the express consent of the state's legislature.  A practicing attorney and a former state tax commission will debate these tactics and explore the constitutional issues and restrictions on extending the economic nexus concept to sales/use taxes.  During their debate, they will provide an analysis of where Quill stands or teeters, including whether the issue will get to the U.S. Supreme Court and whether that Court would reverse Quill.  Jordan M. 2:15 - 3:15pm - From Local Taxes to Federal Tax Reform:  Hot Issues in State and Local Tax - This panel discussion will address six hot topics in today's state and local tax world:  local taxes, including the City of Chicago and Cook County; the impact of recent and proposed federal tax reform; net operating loss issues; partnerships and flow-through entities; strategies in entering voluntary disclosure agreements and amnesty programs; and potential procedural traps at the administrative level.  This session will provide the opportunity for attendees to discuss and learn about some of the most cutting-edge issues in state and local tax and attendees are encouraged to bring to this discussion their own questions and experiences.  Marilyn A. 3:15 - 4:15pm - Wheel of Ethics:  Take a Spin and See What Ethical Dilemma Awaits You - The concepts of confidentiality and privilege arise for attorneys and accountants on a recurring basis.  Ethical considerations, among others, are often part of the multi-faceted analysis that goes into a confidentiality and privilege evaluation.  When, how and to whom do these obligations and protections attach are just a few of the primary questions you need to be able to answer.  This session will focus on ethical issues and standards that tax practitioners need to know regarding the rules of confidentiality and privilege.  An overview of rules and interpretive case law, with interactive discussion about various scenarios and how to address them. David W.
